/ New regime (default from AY 2024-25)

The simpler path.

  • Rates: 0% up to INR 3L / 5% from 3-7L / 10% from 7-10L / 15% from 10-12L / 20% from 12-15L / 30% above 15L.
  • Section 87A rebate: full tax rebate for income up to INR 7 lakh (effective zero tax).
  • Standard deduction INR 75,000 (post Finance Act 2024).
  • Section 80CCD(2) employer NPS contribution deduction allowed.
  • Most other deductions NOT allowed: Section 80C / 80D / 80G / 80E / 80TTA / HRA / home loan interest Section 24.
  • Specific exclusions: can still claim exemption for professional expenses under Section 10(14), gratuity under 10(10), leave encashment 10(10AA), VRS 10(10C).

/ Old regime

Full deduction suite.

  • Rates: 0% up to INR 2.5L / 5% from 2.5-5L / 20% from 5-10L / 30% above 10L.
  • Section 87A rebate: full tax rebate for income up to INR 5 lakh (effective zero tax).
  • Section 80C INR 1.5L: ELSS, PPF, EPF, NPS, LIC premium, tuition fees.
  • Section 80D health insurance: INR 25K self + INR 25K parents + specific senior citizen limits.
  • Section 80G donations: specific 100% / 50% NGO deductions.
  • HRA: lower of (a) actual HRA, (b) rent - 10% of basic, (c) 50% metro / 40% non-metro of basic.
  • Section 24 home loan interest: INR 2 lakh deduction (self-occupied) or unlimited (let-out).
  • Section 80TTA savings interest INR 10K + Section 80TTB senior INR 50K.
  • Section 80E education loan interest (no upper limit).
  • Section 80CCD(1B) NPS additional INR 50K.

/ Decision framework

Choose based on actual deductions.

Rule of thumb: new regime better if your total deductions (80C + 80D + 80G + HRA + home loan interest + specific others) are LESS than approximately INR 3.5 - 4 lakh. Old regime better if deductions exceed that threshold.

Specific scenarios where old regime wins:

  • HRA receiver with high rent in metro: HRA exemption often INR 2-5 lakh alone.
  • Home loan borrower: Section 24 interest INR 2 lakh + Section 80C principal INR 1.5 lakh.
  • Health insurance self + senior parents: Section 80D INR 1 lakh.
  • Combined with Section 80G donations + Section 80E education loan.

Specific scenarios where new regime wins:

  • Young professional with minimal deductions.
  • Rental income (no HRA + no home loan).
  • Simple PPF-only investment with no health insurance / donations.
  • Variable income years where Section 80C target not met.
  • Specific income types below INR 7 lakh (87A rebate zero tax).

/ Switch between regimes

Flexibility rules.

  • Non-business income: can switch between new + old each year. Choose per FY based on actual deduction profile.
  • Business income (Section 44AA books of accounts): once opted out of new regime, can switch back only ONCE in lifetime. Section 115BAC(5) proviso. Significant restriction.
  • Form 10-IEA for business income: specific election required.

FAQ

Common questions, answered.

Is new or old regime default?
New regime is default from AY 2024-25 (FY 2023-24 onwards). Must explicitly opt INTO old regime via Form 10-IEA (for business income) or at ITR filing (for non-business). Non-choice = new regime applied.
Can I switch regimes every year?
For non-business income: yes - switch each year based on actual deduction profile. For business income (Section 44AA books of accounts): once opted out of new regime, can switch back only ONCE in lifetime. Significant restriction - decide carefully.
What's the typical breakeven between regimes?
Approximately INR 3.5 - 4 lakh of total deductions (80C + 80D + 80G + HRA + home loan interest + specific). Below this: new regime typically wins. Above this: old regime typically wins. Specific calculation depends on actual income + specific deductions.
Does new regime allow Section 80CCD(2) employer NPS?
Yes - Section 80CCD(2) deduction for employer NPS contribution allowed in new regime (specific carve-out). This is one of the few deductions preserved in new regime, alongside standard deduction INR 75K + Section 10(10) gratuity + specific exemptions.
Can I use HRA in new regime?
No - HRA exemption under Section 10(13A) NOT available in new regime. If you receive HRA + pay rent + want HRA exemption: must opt into old regime. For salaried with high rent + no home loan, old regime typically wins.
Does BQP help with regime decision + ITR?
Yes - standard tax engagement. Regime decision analysis + 5-year projection + Form 10-IEA for business income + ITR filing in optimal regime + Section 80C/D/G exhaustion planning + capital gain reinvestment.
