Trademark search
Search IPIndia public search (https://ipindiaonline.gov.in) for similar/identical marks in your class. Avoid conflicts.
Identify classes
India follows Nice Classification — 45 classes (34 goods, 11 services). Pick the right class(es) for your business.
Decide priority claim
If filed in India within 6 months of foreign filing, claim priority (Article 4 Paris Convention). Brings foreign filing date.
File TM-A (online)
File on ipindiaonline.gov.in. Pay: ₹4,500 for individual/startup, ₹9,000 for company. Per class. DSC required.
Examination by IPIndia
2-4 months. Examiner issues report. Either accept or raise objections (Section 9 / 11).
Respond to objections (if any)
Reply within 1 month. Common objections: descriptive, similar mark, lack of distinctiveness. We respond + appear in hearings.
Publication in TM Journal
If accepted, mark published in weekly journal. 4-month opposition window.
Registration
If no opposition (or opposition defeated), mark registered. Receive TM certificate. Valid 10 years, renewable.
