NRI Missed the ITR Deadline: What to Do Before 31 December 2026, claim your TDS refund and stay compliant.

Many NRIs skip filing an Indian return because tax was already deducted at source. That usually costs them money: TDS on NRI rent is 30%, on property sales 12.5% to 30% of the gain plus surcharge, and on NRO interest 30%, often well above the tax actually due. If you missed the original deadline for FY 2025-26, you can still file a belated return and claim the refund until 31 December 2026.

/ Do you need to file?

Common NRI triggers.

  • Total Indian income above the basic exemption limit.
  • TDS deducted on rent, NRO interest, dividends or a property sale where you want the excess back.
  • Capital gains on Indian shares, mutual funds or property, even if tax was deducted.
  • You want to carry forward a capital loss (needs a return filed by the original due date; a belated return loses this).
  • Your residential status changed during the year, for example on returning to India.

/ What you need

Documents to send.

  • PAN and passport pages showing India entry and exit dates, to establish residential status.
  • Form 26AS and AIS from the e-filing portal.
  • Form 16A or TDS certificates from tenants, banks or property buyers.
  • Property sale deed, purchase deed and cost of improvement, if you sold property.
  • Tax Residency Certificate and Form 10F if you want treaty rates.

/ After filing

Getting the money home.

  • Refunds are paid to a pre-validated Indian bank account, usually your NRO account.
  • Moving funds from NRO abroad needs Form 15CA, and Form 15CB from a CA above INR 5 lakh, within the USD 1 million per year limit.
  • For next year, consider a lower deduction certificate under Section 197 so less tax is deducted in the first place.

FAQ

Common questions, answered.

Can an NRI file ITR after the due date?
Yes. A belated return for FY 2025-26 can be filed until 31 December 2026 with a late fee of up to INR 5,000.
Will I get my TDS refund if I file late?
Yes, the refund is still allowed. Only interest on the refund may be reduced for the delay.
Do I need to be in India to file?
No. The return is filed and verified online, and BQP works with NRIs entirely by email and video.
What if I miss 31 December too?
You can file an updated return (ITR-U) later, but it cannot be used to claim a refund, so excess TDS for FY 2025-26 would be lost.
Can BQP file my NRI return?
Yes, including DTAA claims, capital gains and repatriation paperwork. Email durgesh@bharatquantumprospera.com or WhatsApp +91 78018 87130 with your CIN/PAN and the notice or deadline you are facing. You get a fixed-scope quote within 48 hours.
