ITR-U Updated Return: 48-Month Window and Additional Tax, disclose missed income before the department finds it.

An updated return (ITR-U) under Section 139(8A) lets you report income you left out, even after the belated and revised deadlines have passed. Finance Act 2025 extended the window from 24 to 48 months from the end of the relevant assessment year. You pay the tax, interest and an additional tax of 25% to 70% of that amount, depending on how late you are.

/ Additional tax by delay

The cost rises each year.

  • Filed within 12 months of the end of the assessment year: 25% of tax plus interest.
  • 12 to 24 months: 50%.
  • 24 to 36 months: 60%.
  • 36 to 48 months: 70%.
  • This is still well below the 50% to 200% penalty under Section 270A if the department detects the income first.

/ When ITR-U is not allowed

Hard restrictions.

  • To report a loss, reduce tax, or increase a refund.
  • If a search or survey has been initiated, or assessment or reassessment is pending or completed for that year.
  • If the department already has information under specified laws and has communicated it to you.
  • More than once for the same assessment year.

/ Who should consider it now

Common cases.

  • Interest, dividends or capital gains visible in AIS but missing from the filed return.
  • Foreign income or assets that were not reported, before the department's exchange-of-information data reaches you.
  • NRIs who became resident and did not report worldwide income in the first resident year.
  • Anyone who expects a Section 148A notice on an older year and wants to disclose first.
