The 10% + aggregation.
- Any person (business / profession) giving benefit / perquisite to resident recipient (business / profession receiver) must deduct 10% TDS.
- Threshold: INR 20,000 per FY per recipient (aggregated).
- Perquisite / benefit forms: free samples, free equipment / vehicles / electronics, conference / travel sponsorship, hospitality, awards, prizes, specific free services.
- Deductor: payer (business providing benefit).
- TDS at 10% on fair market value of benefit (not just cash cost).
- Form 26Q quarterly return + Form 16A to recipient.
- Section 206AA: 20% rate if recipient PAN unavailable.
/ Common 194R trigger scenarios

- Tech / SaaS to beta customers: free API credits, free POCs, free equipment loans, hackathon prizes.

/ Who's exempt
The carve-outs.
- Benefits to resident SALARIED employee: Section 192 TDS applies instead (salary perquisite route).
- Benefits in cash: Section 194R applies if cash > INR 20K / FY. For non-business cash gifts: Section 56(2)(x).
- Discounts + rebates in course of trade: typically not 194R (reduces sale value, not separate benefit).
- Specific entity benefits: company to subsidiary own-group benefits may not be 194R-triggered (specific CBDT clarifications).
- Below INR 20K / recipient / FY aggregate threshold: no 194R.
/ Compliance workflow
The operating playbook.
- Identify all benefit-giving activities + recipients.
- Fair market value estimation for non-cash benefits (equipment, hospitality, travel, prizes).
